3. Sklep www.paski-wybielajace.pl nie jest powiązany ani nie występuje jako przedstawiciel firm Crest, Fairywill, Hello, My Magic Mud, Now, Plus White ani Procter & Gamble.

4. Wszystkie produkty oferowane w Sklepie są oryginalnymi produktami, legalnie zakupionymi na rynku amerykańskim i kanadyjskim w hurtowniach oraz sklepach detalicznych.

5. Sprzedaż marek takich jak Crest, Fairywill, Hello, My Magic Mud, Now, Plus White oraz innych dostępnych w Sklepie odbywa się zgodnie z prawem, na podstawie zasady tzw. first-sale doctrine obowiązującej w USA.

6. Wszystkie produkty oferowane w Sklepie są oryginalne i fabrycznie zapakowane. Ich autentyczność można potwierdzić kontaktując się bezpośrednio z producentem i podając numer seryjny znajdujący się na opakowaniu lub saszetkach.

7. Wszystkie znaki towarowe należą do ich właścicieli. Ich użycie w Sklepie ma wyłącznie charakter informacyjny.

II. DEFINICJE

1. Użytkownik – osoba fizyczna, prawna lub jednostka organizacyjna korzystająca ze Sklepu.

2. Konsument – osoba fizyczna dokonująca zakupu niezwiązanego z jej działalnością gospodarczą lub zawodową.

3. Klient – Użytkownik składający zamówienie w Sklepie.

4. Sprzedawca – KS Trade Inc., właściciel Sklepu.

5. Konto Użytkownika – indywidualne konto utworzone podczas rejestracji w Sklepie.

III. WARUNKI TECHNICZNE

1. Do korzystania ze Sklepu wymagane jest urządzenie z dostępem do Internetu, przeglądarka z obsługą JavaScript oraz aktywne konto e-mail.

2. Sklep wykorzystuje pliki cookies w celach technicznych, analitycznych i marketingowych. Użytkownik może zarządzać cookies w ustawieniach przeglądarki.

3. Sklep nigdy nie wysyła wiadomości e-mail z prośbą o podanie hasła ani danych kart płatniczych.

IV. ZAMÓWIENIA

1. Zamówienia można składać poprzez stronę www.paski-wybielajace.pl.

2. Złożenie zamówienia oznacza zawarcie umowy sprzedaży.

3. Klient zobowiązany jest do podania prawdziwych danych kontaktowych i adresowych.

4. Po złożeniu zamówienia Klient otrzymuje potwierdzenie drogą e-mail.

5. Sprzedawca ma prawo odmówić realizacji zamówienia, jeśli dane są nieprawidłowe lub nie została dokonana płatność.

V. DOSTAWA

1. Dostawy realizowane są do USA, Kanady, Polski oraz wybranych krajów UE.

2. Koszty dostawy są podawane w trakcie składania zamówienia.

3. W przypadku dostawy do UE (w tym Polski) Klient ponosi odpowiedzialność za ewentualne cła i podatki importowe.

4. Klient powinien sprawdzić przesyłkę przy odbiorze.

5. Szczegółowe czasy dostawy dla poszczególnych krajów prezentujemy na stronie Wysyłka & Dostawa oraz w koszyku/kasie przed złożeniem zamówienia.

VI. PŁATNOŚCI

1. Akceptowane metody płatności: PayPal, karty płatnicze, szybkie przelewy internetowe (TPAY).

2. Ceny podawane są w złotych polskich (PLN) lub dolarach amerykańskich (USD) i zawierają podatki zgodnie z prawem USA.

3. Do każdego zamówienia wystawiana jest faktura uproszczona (Invoice).

4. Płatność za pobraniem nie jest dostępna.

VII. ODSTĄPIENIE OD UMOWY – ZWROTY

1. Konsument ma prawo odstąpić od umowy w ciągu 30 dni od otrzymania towaru.

2. Produkt musi być nieużywany i w oryginalnym opakowaniu.

3. Koszty zwrotu pokrywa Sklep Paski-Wybielajace.pl.

4. Domyślny adres zwrotu: KS Trade Inc. Streamwood, IL 60107, USA. Sklep może wskazać alternatywny adres magazynowy e-mailem.

5. Zwrot należności następuje w ciągu 7 dni od otrzymania zwróconego produktu.

VIII. REKLAMACJE

1. Reklamacje można zgłaszać na adres e-mail: sklep@paski-wybielajace.pl.

2. Reklamacja powinna zawierać opis wady i zdjęcia produktu.

3. Sklep rozpatruje reklamacje w ciągu 14 dni.

4. W przypadku uzasadnionej reklamacji Sklep pokrywa koszty przesyłki i zapewnia wymianę produktu lub zwrot pieniędzy.

IX. DANE OSOBOWE

1. Administratorem danych osobowych jest KS Trade Inc.

2. Dane są przetwarzane w celu realizacji zamówień oraz marketingu własnych usług.

3. Podanie danych jest dobrowolne, lecz niezbędne do realizacji zamówienia.

4. Użytkownik ma prawo dostępu, poprawienia, ograniczenia przetwarzania, przeniesienia i usunięcia danych (zgodnie z RODO/GDPR).

X. PRAWA AUTORSKIE I ZNAKI TOWAROWE

1. Wszystkie materiały publikowane w Sklepie (zdjęcia, opisy, grafiki) są chronione prawem autorskim.

2. Kopiowanie lub rozpowszechnianie materiałów bez zgody Sprzedawcy jest zabronione.

3. Wszystkie znaki towarowe i nazwy produktów, w tym Crest, Fairywill, Hello, My Magic Mud, Now, Plus White oraz inne, należą do ich właścicieli i są używane wyłącznie w celach informacyjnych.

XI. POSTANOWIENIA KOŃCOWE

1. Sprzedawca zastrzega sobie prawo do zmiany Regulaminu. Zmiany wchodzą w życie po 14 dniach od publikacji w Sklepie.

2. W sprawach nieuregulowanych Regulaminem zastosowanie mają przepisy prawa USA.

3. Wszelkie spory rozstrzygane będą przez sądy właściwe dla siedziby Sprzedawcy (Illinois, USA).

4. Postanowienia Regulaminu nie wyłączają bezwzględnie obowiązujących praw konsumenta wynikających z prawa państwa jego zwykłego pobytu w UE.

5. Regulamin obowiązuje od dnia 01.10.2025.

XII. DODATKOWE POSTANOWIENIA DOTYCZĄCE PRODUKTÓW I REALIZACJI ZAMÓWIEŃ

1. Produkty oferowane w ramach Usług mogą pochodzić z różnych rynków dystrybucji, w szczególności z rynku amerykańskiego, kanadyjskiego lub innych rynków, na których zostały one wprowadzone do obrotu przez producenta.

   W zależności od partii produkcyjnej oraz rynku przeznaczenia, produkty mogą różnić się w szczególności:

   • szatą graficzną opakowania,
   • językiem oznaczeń,
   • oznaczeniami technicznymi,
   • numeracją partii,
   • drobnymi elementami składu zgodnie ze specyfikacją producenta dla danego rynku.

   Powyższe różnice nie stanowią wady produktu, nie wpływają na jego autentyczność ani na jego przeznaczenie.

2. Opisy produktów, zdjęcia oraz informacje zamieszczone w ramach Usług mają charakter informacyjny i opierają się na danych udostępnianych przez producenta lub oficjalne kanały dystrybucji.

   Sprzedawca nie prowadzi niezależnych analiz laboratoryjnych ani technicznych produktów, w szczególności w zakresie ich wewnętrznej konstrukcji, parametrów technicznych lub szczegółowej specyfikacji chemicznej.

   Sprzedawca nie gwarantuje identyczności wszystkich parametrów technicznych pomiędzy różnymi partiami produktu.

3. Zamówienia mogą być realizowane z różnych lokalizacji logistycznych, w zależności od dostępności towaru, wielkości zamówienia oraz optymalizacji czasu i kosztów dostawy.

   Lokalizacja wysyłki nie wpływa na ważność zawartej umowy sprzedaży ani na autentyczność oferowanego produktu.

4. Sprzedawca prowadzi sprzedaż o charakterze detalicznym.

   Sprzedawca zastrzega sobie prawo do:

   • ograniczenia liczby produktów możliwych do nabycia w ramach jednego zamówienia,
   • odmowy realizacji zamówienia w przypadku uzasadnionego podejrzenia działania sprzecznego z Regulaminem,
   • wstrzymania realizacji zamówienia w celu weryfikacji danych, płatności lub autentyczności transakcji,
   • anulowania zamówienia i zwrotu środków w przypadku stwierdzenia nadużycia, próby zakupu o charakterze hurtowym, odsprzedażowym lub innego działania mogącego naruszać interes Sprzedawcy.

   Decyzje w powyższym zakresie podejmowane są indywidualnie i nie wymagają szczegółowego uzasadnienia.

5. Klient przyjmuje do wiadomości, że przepisy dotyczące importu, oznaczeń, użytkowania oraz dopuszczenia produktów do obrotu mogą różnić się w zależności od kraju dostawy.

   Klient ponosi odpowiedzialność za zapoznanie się z regulacjami obowiązującymi w kraju dostawy oraz za ewentualne obowiązki wynikające z przepisów celnych, podatkowych lub administracyjnych.

   Sprzedawca nie ponosi odpowiedzialności za decyzje organów celnych, administracyjnych ani regulacyjnych właściwych dla kraju dostawy.

3. The Store www.paski-wybielajace.pl is not affiliated with, nor does it act as a representative of Crest, Fairywill, Hello, My Magic Mud, Now, Plus White, or Procter & Gamble.

4. All products offered in the Store are genuine products, legally purchased on the U.S. and Canadian markets from authorized wholesalers and retail outlets.

5. The sale of brands such as Crest, Fairywill, Hello, My Magic Mud, Now, Plus White and others available in the Store is conducted legally under the principle of the U.S. first-sale doctrine.

6. All products offered in the Store are original and factory-sealed. Authenticity may be verified directly with the manufacturer by providing the serial number located on the packaging or sachets.

7. All trademarks are the property of their respective owners. Their use on this website is for informational purposes only.

II. DEFINITIONS

1. User – any natural person, legal entity, or organizational unit using the Store.

2. Consumer – a natural person making a purchase not related to their business or professional activity.

3. Customer – a User placing an order in the Store.

4. Seller – KS Trade Inc., operator of the Store.

5. User Account – an individual account created during registration in the Store.

III. TECHNICAL REQUIREMENTS

1. To use the Store, the User needs an Internet-enabled device, a browser with JavaScript enabled, and an active e-mail account.

3. The Store never sends e-mails requesting passwords or payment card details.

IV. ORDERS

1. Orders may be placed via the website www.paski-wybielajace.pl.

2. Placing an order constitutes a sales agreement.

4. Upon placing an order, the Customer receives an e-mail confirmation.

5. The Seller reserves the right to refuse an order if incorrect data is provided or payment is not received.

V. DELIVERY

1. Deliveries are made to the USA, Canada, Poland, and selected EU countries.

2. Delivery costs are displayed during the order process.

3. For deliveries to the EU (including Poland), the Customer is responsible for any import duties and taxes.

4. Customers are advised to check the package upon delivery.

5. Detailed delivery times by destination are provided on the Shipping & Delivery page and at cart/checkout before you place the order.

VI. PAYMENTS

1. Accepted payment methods: PayPal, credit/debit cards, and online transfers (TPAY).

2. Prices are displayed in Polish zloty (PLN) or U.S. dollars (USD) and include applicable taxes under U.S. law.

3. The Store issues a simplified invoice (Invoice) for each order.

4. Cash on delivery is not available.

VII. RIGHT OF WITHDRAWAL – RETURNS

1. Consumers have the right to withdraw from the sales agreement within 30 days of receiving the product.

2. The product must be unused and in its original packaging.

3. Return shipping costs are covered by the Store Paski-Wybielajace.pl.

4. Default return address: KS Trade Inc. Streamwood, IL 60107, USA. The Store may provide an alternative warehouse address via e-mail.

5. Refunds are processed within 7 days after the Store receives the returned product.

VIII. COMPLAINTS

1. Complaints can be submitted by e-mail to: sklep@paski-wybielajace.pl.

2. The complaint should include a description of the defect and photos of the product.

3. The Store reviews complaints within 14 days.

4. In the case of a justified complaint, the Seller covers shipping costs and ensures either a replacement product or a refund.

IX. PERSONAL DATA

1. The data controller is KS Trade Inc.

2. Personal data is processed for order fulfillment and marketing of the Store’s own services.

3. Providing personal data is voluntary but necessary to process an order.

4. Users have the right to access, rectify, restrict processing, transfer, and delete their personal data (in accordance with GDPR).

X. COPYRIGHTS AND TRADEMARKS

XI. FINAL PROVISIONS

2. Matters not covered herein are governed by U.S. law.

3. Any disputes shall be settled by the courts competent for the Seller’s registered office (Illinois, USA).

4. Nothing in these Terms limits mandatory consumer protection rights applicable in the Customer’s country of residence in the EU.

5. These Terms and Conditions are effective as of 01.10.2025.

XII. ADDITIONAL PROVISIONS REGARDING PRODUCTS AND ORDER FULFILLMENT

1. Products offered within the Services may come from different distribution markets, in particular the U.S. market, the Canadian market, or other markets where they have been legally placed on the market by the manufacturer.

   Depending on the production batch and the destination market, products may differ in particular in:

   • packaging design,
   • labeling language,
   • technical markings,
   • batch/lot numbering,
   • minor ingredient elements in accordance with the manufacturer’s specification for a given market.

   The above differences do not constitute a product defect, do not affect its authenticity or intended use, and may not constitute grounds for a complaint.

2. Product descriptions, photos, and information provided within the Services are for informational purposes only and are based on data made available by the manufacturer or official distribution channels.

   The Seller does not conduct independent laboratory or technical analyses of products, in particular with respect to their internal construction, technical parameters, or detailed chemical specification.

   The Seller does not guarantee that all technical parameters will be identical between different product batches.

3. Orders may be fulfilled from different logistics locations depending on product availability, order size, and the optimization of delivery time and shipping costs.

   The shipping location does not affect the validity of the sales agreement or the authenticity of the product offered.

4. The Seller conducts retail sales.

   The Seller reserves the right to:

   • limit the number of products that may be purchased within a single order,
   • refuse to fulfill an order in the event of a reasonable suspicion of conduct contrary to these Terms and Conditions,
   • withhold order fulfillment in order to verify data, payment, or the authenticity of the transaction,
   • cancel an order and refund the payment if an abuse is detected, including an attempt to purchase for wholesale/resale purposes or other conduct that may violate the Seller’s interests.

   Decisions in this scope are made on an individual basis and do not require a detailed justification.

5. The Customer acknowledges that regulations regarding import, labeling, use, and placing products on the market may vary depending on the country of delivery.

   The Customer is responsible for familiarizing themselves with the regulations applicable in the country of delivery and for any obligations arising from customs, tax, or administrative regulations.

   The Seller is not responsible for decisions of customs, administrative, or regulatory authorities competent for the country of delivery.
